alright. i admit i haven't given a real entry here in say... a month??? it's been a handful of memes and some writerly whining.
NOT TODAY, PEOPLE.
today i give you whining of another sort. at the end of august, upon killing time driving around louisville before lunch and work, i drove through downtown. and had a teeny accident with a bus. i may have told you this before, but you know, whatever. that same day i'd been kicked out of UofL for yet another semester, been scammed out of money, had no sleep and was otherwise crapped out. so, while trying to get around a bus that was, i realized belatedly, sitting partially in my lane, i may have misjudged the distance i had and SIDESWIPED THE BUS.
now, the damage was basically non-existent on the bus, possibly a scrape on the left corner of the back bumper. my dad's van?? lost a passenger side mirror and all the trim and a little paint. not a bad accident, but an ugly one on the van.
so, i was shell-shocked and shaky and whatnot and barely able to speak without crying that day. and this was compounded with the fact that while i wasn't on campus, my mom fell in the bathroom, twisted her knee and got caught under her wheelchair. no one knew she fell until about half an hour after it happened. i was nowhere to be found, my dad had to pull my mom up, and exacerbated his pre-existing injuries (herniated disc in his neck, trapped sciatic nerve in his leg). so. while i wasn't where i ought to be, disaster was striking.
so. about two weeks after i got back in the country, i got a letter from Joe Schmoe Lawyer Fellow informing me that i was being SUED FOR DAMAGES to the busdriver. excuse me???? this same guy who was standing out directing traffic and trying to comfort me and showing me that it wasn't all that bad??? what.the.fuck?
so for the past month, my dad's been trying to get me to get the accident report. and i've been putting it off cause (a) i didn't know where to get it, (b) i'm scared of trying to get it alone, (c) who knows what it said about what happened, and (d) i was trying really hard to put that day behind me because i was an ass and i hate being reminded of it. finally, today, i got the report.
you know what it said??? MINOR DAMAGE. LESS THAN 15 MPH. NO INJURIES. NO PICTURES. NOTHING. if it wasn't for the report and the damage to my dad's van, THE ACCIDENT WOULDN'T EXIST. and it even says that the accident was a misjudgement of clearance. no real harm done.
so. here's what's gonna happen. i'm getting sued for imaginary damages. me??? i'm going to state my case very clearly (i was upset, the bus was partially in my lane, no damage done except to my van). and then I'M COUNTERSUING THE FUCKER. for damage to the van for his clear disregard for minding his lane, and for fucking emotional damages. did you know i had to leave the country for almost a month to recuperate???
god i hate stupid cases.

Insurance Companies
Date: 2007-11-08 11:35 pm (UTC)Since the accident was your fault, the bus driver had a year to respond/file a claim (at least that is what it is in most cases) and the truth is, it may be all kinds of bullshit, but if it was your fault, he can sue you. My guess is that your insurance company stalled or didn't pay out as soon as he wanted, so he got his lawyer involved.
Don't panic. He doesn't have much of a case, and even if he does, your insurance company has money to help take care of it. It is part of what you pay for if you have good coverage.
